How Colorado divides property

Colorado is an equitable distribution state. Marital property and debt are divided fairly, which isn’t always equally, while separate property generally stays with its owner.

The family home

Selling, refinancing, or one spouse keeping the house, and what that means for the rest of the split.

Retirement accounts

Dividing 401(k)s, pensions, and IRAs with the right orders to avoid taxes and penalties.

Debt

Mortgages, car loans, credit cards, and student loans, and who is responsible for each.

Separate property

Premarital assets, gifts, and inheritances, and any growth in value during the marriage.

Vehicles and personal property

Cars, furnishings, and valuables, without fighting over every item.

Tax consequences

Making sure an even-looking split doesn’t leave you with the tax bill.

Property & asset division questions

Every case is different. These are the questions Centennial clients ask most in the first call.

Who gets the house in a Colorado divorce?

It depends on equity, income, the parenting plan, and the rest of the property division. Many couples sell; sometimes one spouse buys the other out.

Is an inheritance marital property?

An inheritance is usually separate property, but any increase in its value during the marriage can be marital.

Are debts divided too?

Yes. Marital debts are divided along with assets, regardless of whose name is on the account.

What date are assets valued?

Generally, as of the date of the decree or permanent orders hearing, though there are exceptions.
