How spousal maintenance works in Colorado
Colorado uses an advisory guideline based on both spouses’ incomes and how long the marriage lasted. The court can depart from it after looking at the full picture.
Amount
How the guideline treats each spouse’s income, and when actual income or earning capacity matters.
Duration
How the length of the marriage shapes how long maintenance lasts.
Temporary maintenance
Support while the divorce is still pending, so neither spouse is left without income.
Self-employment income
Accurately showing income when one spouse owns a business or is paid irregularly.
Modification
Changing maintenance after a job loss, raise, or other substantial change.
Ending maintenance
When it ends on remarriage, death, or the end of its term, and when it doesn’t.

Alimony & spousal support questions
Every case is different. These are the questions Centennial clients ask most in the first call.
Will I have to pay alimony?
It depends on the gap in incomes, the length of the marriage, and other factors. Your attorney can estimate it in your first meeting.
How long does spousal maintenance last in Colorado?
The guideline ties duration to the length of the marriage. Shorter marriages usually mean shorter terms.
Can maintenance be changed later?
Often, yes, if there’s a substantial and continuing change in circumstances, unless the agreement says it can’t be modified.
Is alimony taxable?
For divorces finalized after 2018, federal law no longer treats maintenance as deductible for the payer or taxable to the recipient.
