Military divorce questions
Every case is different. These are the questions Prescott clients ask most in the first call.
Can I file for divorce in Arizona if I’m stationed here?
Usually, yes. Arizona requires at least one spouse to have lived in the state, or been stationed here, for 90 days before filing.
Will my spouse get half my military retirement?
Not all of it. Retired pay earned during the marriage is community property in Arizona, so that share is generally divided equally. The part earned before or after the marriage stays yours.
Can my divorce be delayed while I’m deployed?
Active-duty service members can ask the court to pause proceedings under the Servicemembers Civil Relief Act.
Do you work with veterans in the Prescott area?
Yes. We work with service members, veterans, and military families throughout Yavapai County and northern Arizona.
