What makes a military divorce different

State law decides the divorce, but federal law shapes the money and the timing. Getting both right protects your benefits and your time with your kids.

Military retirement pay

How the Uniformed Services Former Spouses’ Protection Act lets Colorado courts divide retired pay.

Direct payment from DFAS

When a former spouse can be paid directly by the Defense Finance and Accounting Service.

Deployment and timing

How the Servicemembers Civil Relief Act can pause a case while a service member is on active duty.

Parenting while serving

Parenting plans that plan ahead for deployments, PCS moves, and long training rotations.

Survivor Benefit Plan

Whether a former spouse keeps survivor coverage, and how that has to be elected in time.

Where to file

Choosing the right state when you’re stationed in Colorado but call somewhere else home, or the reverse.

Military divorce questions

Every case is different. These are the questions Fort Collins clients ask most in the first call.

Can I file for divorce in Colorado if I’m stationed here?

Usually, yes. Colorado requires at least one spouse to have lived here 91 days before filing, and being stationed here can count.

Will my spouse get half my military retirement?

Not automatically. Colorado courts can divide retired pay earned during the marriage, and how much depends on the length of the marriage and service.

Can my divorce be delayed while I’m deployed?

Active-duty service members can ask the court to pause proceedings under the Servicemembers Civil Relief Act.

Do you work with military families?

Yes. We work with service members and spouses at Buckley Space Force Base and installations across the Front Range.
